Terms of Service and User Agreement
By purchasing and having access to the Trade Alert algorithms and its associated trading algorithm alerts, User agrees to the terms and conditions set forth in this Agreement.
1. Nature of Alerts
The Alerts provided by the trading algorithm are intended solely as a tool to assist the User in understanding the current state of the market environment. The Alerts are not to be construed as investment advice or recommendations to buy, sell, or hold any financial instrument. User acknowledges that trading involves inherent risks, and the decision to act upon any Alert is at User's sole discretion and risk.
2. No Guarantee of Accuracy or Performance
Provider makes no representations or warranties regarding the accuracy, reliability, or completeness of the Alerts. User acknowledges that the performance of the trading algorithm may vary, and past performance is not indicative of future results. Provider shall not be liable for any losses or damages incurred by User as a result of relying on the Alerts.
3. User Responsibility
User acknowledges that they are solely responsible for conducting their own due diligence and making informed trading decisions. User agrees not to rely solely on the Alerts as the basis for their trading activities. User should consult with a qualified financial advisor or conduct independent research before making any trading decisions.
4. Limitation of Liability
To the fullest extent permitted by law, Provider disclaims any and all liability for any direct, indirect, incidental, consequential, or punitive damages arising out of or relating to User's use of the Alerts, including but not limited to any losses incurred in connection with trading activities. User agrees that Provider shall not be liable for any damages or losses, regardless of the cause of action or legal theory asserted.
5. Indemnification
User agrees to indemnify and hold harmless Provider, its affiliates, officers, directors, employees, and agents from and against any and all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to User's use of the Alerts or any breach of this Agreement.
6. Market Volatility and Risk Acknowledgment
User acknowledges that financial markets are inherently volatile and unpredictable. While the trading algorithm endeavors to identify opportunities, not all alerts guarantee profitable recommendations, and some alerts may result in small losses. User understands and accepts the inherent risks associated with trading and acknowledges that the algorithm may not always accurately predict market movements. Provider strives to minimize the possibility of erroneous alerts but cannot guarantee their complete elimination. User agrees to exercise caution and discretion when acting upon any Alert and acknowledges that they bear full responsibility for any trading decisions made based on the Alerts provided.
7. Non-Disclosure Agreement
User agrees that all information obtained from the Alerts, the Forum, or any associated reports is confidential and proprietary to Provider. User shall not disclose, share, or disseminate any such information to any third party without the prior written consent of Provider. Any unauthorized disclosure or sharing of information shall constitute a breach of this Agreement and may result in legal proceedings against User for damages and injunctive relief. User agrees to take all necessary measures to safeguard the confidentiality of the information and to prevent its unauthorized use or disclosure. This non-disclosure obligation shall survive the termination or expiration of this Agreement.

9. Entire Agreement
This Agreement constitutes the entire agreement between Provider and User regarding the subject matter hereof and supersedes all prior or contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written. By accessing the Forum and its Alerts, User acknowledges that they have read, understood, and agreed to be bound by the terms and conditions of this Agreement. If User does not agree to these terms, they should refrain from accessing any Trade Alert algorithm or product.
